Can I elect to have my employer not withhold taxes from my check?

I am full time employed and they take taxes out of my check which is fine. BUT I am doing some part-time work on the side for them which they pay seperately. I do not want them to withhold taxes for that because is it a small amount and I would practically not get anything for the days work.

My husband and I file the long form and we know we will be getting money back this year.

Can I legally ask them not to withhold money from this side payment check?

If your part-time job is small, they probably will not withhold much from it anyway. And even though having money taken from your side job makes the check look smaller, it all comes out in the wash anyway, whether it is taken from your regular check or your part-time one.

You have one Form W-4 filed for your employer. You can't ask to have a different W-4 for different checks.

The bigger issue is that you seem to be having too much withheld from your and your husband's paychecks. I recommend that you figure out how much you are having overwithheld -- generally the amount you get back every year. Increase your number of exemption allowances until you have the right amount withheld.

You can get Form W-4 at http://www.irs.gov/pub/irs-pdf/fw4.pdf?portlet=3 . Ignore everything but the form on the bottom of page 1. Fill it out and give it to your payroll department. When your next check comes, see if they are withholding the right amount so you get only a small refund next year. If it's still not right, file Form W-4 again.

You're working hard at a job and a half -- you should get more of your money now!
